Welcome to Ongoclick. These Terms & Conditions (“Terms”) govern your access to and use of the Ongoclick website, digital platform, products, and services.

NFC cards and NFC-enabled products
QR codes and QR-based solutions
Digital menus
AI review stands and review solutions
Digital branding and marketing tools
Business listing and promotional services
Other digital products and services introduced by Ongoclick from time to time.

2. Eligibility

You must provide accurate and complete information while registering for or purchasing any Ongoclick service.

You confirm that:

You are legally capable of entering into an agreement.
The information provided by you is accurate and up to date.
You will use Ongoclick services only for lawful purposes.
You will not use the platform for fraudulent, misleading, illegal, or abusive activities.

3. Account Registration

Certain Ongoclick services may require registration or creation of an account.

You are responsible for:

Providing correct information.
Maintaining the confidentiality of your login credentials.
Keeping your account information updated.
All activities performed through your account.

Ongoclick reserves the right to suspend or terminate accounts containing false, misleading, fraudulent, or unauthorized information.

4. Digital Profiles & Business Information

Users are responsible for the accuracy of information submitted for their digital profile or business listing.

This may include:

Business name
Address
Contact information
Website links
Social media links
Business hours
Products and services
Images, logos, videos, and other content.

Ongoclick is not responsible for inaccuracies resulting from information supplied or approved by the customer.

Customers are responsible for ensuring that they have the necessary rights and permissions to use any logo, photograph, trademark, text, video, or other content submitted to Ongoclick.

5. NFC Cards, QR Codes & Physical Products

NFC cards, QR products, stands, displays, and other physical products are produced according to the information and specifications provided or approved by the customer.

Once production has started, changes to the submitted information may not be possible or may incur additional charges.

Ongoclick is not responsible for damage caused by improper handling, misuse, modification, or normal wear and tear of physical products.

NFC and QR functionality may depend on compatible devices, internet connectivity, third-party applications, browsers, or other external services.

6. Payments

All prices displayed on the Ongoclick website or communicated by Ongoclick are subject to applicable taxes and service charges unless specifically stated otherwise.

Payment may be required before the activation, production, delivery, or commencement of certain services.

Ongoclick reserves the right to modify its pricing, plans, features, and service charges at any time. Changes will generally apply to future purchases or renewals.

7. Orders & Service Activation

For digital services, activation may take place after successful payment and receipt of the required information from the customer.

For physical products, processing and delivery timelines may vary depending on product type, customization, production requirements, courier services, and the customer’s location.

Estimated delivery or activation timelines are not guaranteed unless expressly confirmed in writing by Ongoclick.

8. Refund & Cancellation

Refund eligibility depends on the nature and stage of the service or product.

Customized, personalized, digital, or already-activated services may not be eligible for cancellation or refund once work or production has commenced.

If a physical product is received damaged or defective, the customer should contact Ongoclick within a reasonable period after delivery and provide appropriate photographs or other evidence.

Any approved refund will be processed according to Ongoclick’s applicable refund policy and the original payment method, where technically possible.

9. User Content

You retain ownership of content that you submit to Ongoclick.

However, you grant Ongoclick permission to use, host, reproduce, display, and process such content as reasonably necessary to provide the services requested by you.

You represent that your content does not:

Violate any applicable law.
Infringe intellectual property rights.
Contain fraudulent or misleading information.
Contain malware or malicious code.
Promote illegal activities.
Violate the rights or privacy of another person.

Ongoclick may remove or restrict content that violates these Terms or applicable law.

10. Prohibited Activities

Users must not use Ongoclick services to:

Conduct fraudulent activities.
Promote illegal products or services.
Impersonate another person or business.
Upload malicious software or harmful code.
Attempt unauthorized access to Ongoclick systems.
Abuse, disrupt, or interfere with the platform.
Misuse QR codes, NFC products, digital profiles, or other Ongoclick services.
Publish content that violates applicable laws or third-party rights.

Ongoclick may suspend or terminate access where prohibited activities are identified.

11. Third-Party Services & Links

Ongoclick services may contain links to or integrations with third-party websites, applications, payment providers, social media platforms, mapping services, analytics services, or other external services.

Ongoclick does not control and is not responsible for the availability, content, security, privacy practices, or policies of third-party services.

Your use of third-party services is subject to their respective terms and privacy policies.

12. Intellectual Property

All Ongoclick trademarks, logos, website designs, graphics, software, text, layouts, and other proprietary materials are owned by or licensed to Ongoclick unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit Ongoclick’s proprietary materials without prior written permission.

Customer-owned trademarks, logos, photographs, and other materials remain the property of their respective owners.

13. Service Availability

Ongoclick aims to provide reliable and continuous services but does not guarantee that the website or digital services will always be available without interruption.

Services may temporarily become unavailable due to:

Maintenance
Technical problems
Internet or network failures
Third-party service outages
Security incidents
Force majeure events
Other circumstances beyond Ongoclick’s reasonable control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Ongoclick shall not be liable for indirect, incidental, special, consequential, or business losses arising from the use or inability to use its services.

Ongoclick shall not be responsible for losses resulting from:

Unauthorized access caused by compromised customer credentials.
Misuse of Ongoclick products or services.
Events beyond Ongoclick’s reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. Suspension & Termination

Ongoclick may suspend or terminate access to a service or account if:

These Terms are violated.
False or misleading information is provided.
Payments remain outstanding.
The service is being used for unlawful purposes.
The account creates a security or operational risk.
Required by law or regulatory authorities.

Upon termination, certain digital services may become unavailable.
